I have the honour to acknowledge the

receipt of your Secret despatch of the 14th

December, 1931, on the subject of Hong Kong Ordinance

No.7 of 1931, and to state that a draft bill,

incorporating certain amendments has been prepared by

the Attorney General. A copy is enclosed.

The draft was referred to the judges for

their comments, and copies of their letters in reply

are attached. Their main objection is that it is

undesirable to associate the Judiciary with the

Executive in the exercise of powers of an arbitrary

and executive nature. To meet these objections,

whilst maintaining the essential provisions of the

Bill, it is proposed to make the following amendments

to the draft:-

(i) delete paragraphs (a), (b) and (c) of

clause 6 (i).

(ii) delete the last sixteen words of paragraph

(2) of clause 6.

(iii) delete the whole of paragraph (3) of clause 6.

(iv) delete the last sentence of clause 19.
